We were in the same boat as many and looking to have our ARM loan modified. We were contacted by U.S. Loan assistance center out of CA and the guy pitching assured us our loan was "exactly the type they could work with". We sent them $1,500.00 and within a week, couldn't get a call back. Two months later they informed us there was nothing they could do for us and we were just out the money.
We then contacted our bank and did our own loan modification within 2 weeks.
U.S. Loan Assistance Center (USLAC) was a HUGE RIP-OFF!!!!!

i just wanted to let everybody on this on an expericence that i have just

encountered within the last year. My wife and i had purchased our dream home back

in the summer of 06. Like all families we were both excited about the home itself,

and the fact that we were going to live out the american dream. We went through

the whole process with our broker, i felt excited, yet at the same time still worried.

how am i to pay back such a large loan (630k) the total income for the family was

around $4,500, but with 3 kids, only one can imagine the position we would be in from

the begining!!! Our broker had assured us that "It is definately a tough scenerio

but he guarnteed that he can make it work and that we would get the loan."

We got the mortgage aite, originally it was agreed the interest rate would be at a

6.5 At a fixed rate. At the signing of the documents, we signed with happiness

because we truely believed that we would be able to survive!



A month later we recieved our 1st statement, $2,131.15!!! It was 400 more than what

was agreed on! we immediately called our broker and told him of this mishap. He told

us that "we can refiance the home in the future at a lower rate, lender is offering

this right now but we will be ok"



Months passed, we struggled. It was difficult to manage with children and sudden expenses.

I called the broker again, only to find out... he is no longer around. my wife was

starting to panic i assured her that we would be able to manage this together.



We struggled for close to 2 years, everyday it was the constant battle with the lender.

We requested for a refiance, but since our income didnt meet the requirements, we

were denied. All the phone calls we gettin us nowhere!



We finally fell behind, then the calls started. the lender called us harassing us for

our payments and even threatened foreclosure. Even tho we were waiting for an offical

response from them! one day i went online and put my information down for a loan modification.

i figured since bush's and obama's programs were not helping me, i needed to do something.





i encountared alot of loan mod companies promosing the world to me, i was about to give up...

when someone from www.foreclosurepreventionplan.com called me. I told the Rep (Rick), to leave me alone.

I know what he is trying to sell me and i was already trying to decide with 3 other companies.

He told me that he does free modification. Now, this was different... the other companies were

charging up to 5k for mods. i asked him "how is that?" he told me "its all taken care of the

back end."



So i listened to what he said, he mentioned a Forensic Loan Audit. I had never heard of that.

He explained to me that lenders were taken advantage of home owners during the years of 01-08.

which makes alot of sense, because my loan was different from what i signed!!!



I was convinced, legal leverage as opposed to financial hardship, i have to get a modification now!

the process took close to 90 days. not going to lie, i was nervous lol

but www.foreclosurepreventionplan.com had great communication with me through the whole process. When i finally got the audit,

they had found 2 major violation in TILA! They explained to me everything i had to know

about the report and it was sent to my lender.



With 2 weeks, i got my modification, it was a 3.5% and my payments were cut in half!!! every payment

i missed, was deferred to the end of the mortgage!

If anybody may feel that the lender has wronged them or even if you think they didnt...

i would suggest to call them it will be your best call yet!

Wow, theres a tn of great information on this site. thank you all for sharing. i have been researching loan modification options for about a week or so and i have decided to do my own modification. the site that sold me is www.myhss.net they have, so far, gone above and beyond when it comes to customer service and there product was priced right. hope this information is able to help someone.

Hi All,

Just a heads up for anyone in the Bay Area of Northern California - We contracted a company called Cal Coast Mortgage in Fremont, CA. They promised us the world verbally, but failed to deliver on their promises.

I was current when I signed up with them after losing my job to try and get a modification on my $650,000 loan on my house which is now worth 275,000 (5K/month payment).

After 3 months of waiting and falling further and further behind, they didn't come through and wouldn't refund any of my money. It looks as though I am now facing foreclosure for certain and possibly Chapter 7. What a great value for $3,000.00.

I have an adjustable mortgage with 6.7% interest that is due to re-adjust next year. The value of my home has decreased so that it is not worth the amount that I owe. I have been able to make my mortgage payment on time, but I am falling behind in everything else. I do not qualify for a refinance.
Should I deal with my lender, Wachovia, directly to modify my present loan or should I hire a legal firm for $2,900 to handle this for me. They guarantee no money will be charged if they fail to obtain an acceptable modification. How hard is it to renegotiate a mortgage without legal representation?

READ what the BBB has to say about "loan Modification services" Google it.

Your Lender is REQUIRED to work with you to modify your loan.
Any company that calls repeatedly using an automated system to harass homeowners like 21st Century is a rip off.
I am on the no call list and still they call twice an hour until I am forced to speak with a representative and threaten them into not calling in the future.

All those glowing stories above are promotional efforts for a rip off scheme.

I ran into some financial trouble a while back and, well, needless to say it put me in a tight spot. I tried to have a modification done but with all the negative press I was concerned about who to choose. I found a company who seemed reputable and was charged a $2300 fee up front. After about 3 months with no results I became impatient. When I would call to check status they would have a different answer every time for why my modification wasn't done. After 4 months my lender was foreclosing and I was on the brink of losing my home. In a panic to save the home that me and my family live in I searched everywhere for an option. I tried to do a modification with the bank by myself but they were blowing me off and making me jump through hoops just to get a call back. An attorney friend of mine, who did not specialize in real estate law, said he had heard good things about a do it yourself kit offered at WWW.MyHomeSavingSolution.com. Tired, frustrated, and at wits end, I visited the site and purchased the package he recommended. I did this about 3 weeks ago and since then I followed the steps and it has worked amazingly well. I have spoken with my bank several times and we have come to a modification agreement which is being finalized this week. After all is said and done, I will have eliminated my past due balances and the bank gave me a 5.25% 30 yr fixed (as opposed to my arm which was at 12.25%) and they credited me $31,000 off my principal. I am no expert but the kit boasted a certain document that, as far as I’m concerned, was the reason for my success. once aware of the fsla document the bank contacted me within 24 hours looking to come to "an arrangement". my attorney friend explained that the fsla (full spectrum legal analysis) was a tool that has been used for years by attorneys to accomplish just that, a successful modification. Apparently there were legal infractions on my loan with the bank and that’s why they were so willing to help. Now... just for the record... yesterday, I contacted the modification company that I had hired and asked for a status (just to see what they would say). they informed me that the bank was not willing to do a modification on my loan and stated several reasons. Knowing that they were lying, I demanded to speak with the manager. After yelling at him for over an hour and explaining that I had done in less than a month what he had been supposedly trying to do for over 4 months, I threatened to call the atty generals office and I received a refund in full. Later that day, I contacted the atty general’s office and filed a complaint about that company only to find that they were already under investigation. moral of the story is... this specific kit worked wonders for me and my family. my home appears to be saved and my children will continue to have a comfortable roof safely over their heads. At the end of the day that is all I cared about. So as a father, as a man who has been in this specific bind, and as a human being that wants to be able to do something good for others I am recommending the very same product I purchased at WWW.MyHomeSavingSolution.com. If this is able to help anyone out there then I have done my good deed for the day

Here are some of the loan modification scams we are seeing. If you have been a victim of any of these activities please contact us for a free consultation. We will look up the loan modification company and see if they are properly licensed to engage in the loan modification business. In addition, we will scrutinize their activities to see if they were negligent in performing loan modification services.

(1) Non-compliant company loan modification scam: In order to perform loan modifications in California a Broker is required. The California Department of Real Estate ("DRE") has declared loan modifications to be a licensed activity. As such, a Broker's license is required and any salesperson working under the Broker must also be licensed. In addition, loan modification marketing, solicitation, processing and negotiation has also been determined to be licensed activity by the DRE. We will investigate your company to see if they are properly licensed. If not, we will seem an injunction preventing them from engaging in the loan modification business and seek to prevent future loan mod scams by the unlicensed or non-compliant entity. Note: If the Broker accepts an advance fee (charges you a fee for the service) they are required to have a loan modification contract that has received a letter of non-objection from the DRE. There are only a limited number of companies with an approved advance fee agreement (we will investigate this).


(2) Attorney-backed / Attorney-based loan modification scam: This is the new flavor of the day in loan modification scams. Attorneys are lending their names and credentials to a loan modification company (which may either be properly licensed or not). The Client thinks they are hiring a lawyer and that they have put their foreclosure issue in the hands of a qualified attorney. In many cases, the Attorney either does not exist, or merely lended the broker the use of the name, address, and merchant credit card account so that the broker can bring in loan modification business by holding itself our as a legal entity of sorts. Both the California State Bar and the DRE have tried to warn both brokers and attorneys about this very questionable conduct that raises issues over attorney fee splitting, partnerships with non-attorneys, circumvention of the California Foreclosure law, and violation of the Attorney-Client relationship. Be very careful when thinking about going with an "attorney based" or "attorney backed" firm. Ask yourself why you wouldn't just go straight to an attorney.

(3) Take the money and run loan modification scam: With the Internet any scam artist can hold itself out as a real company. We are seeing more and more loan modification companies that appear to be operating covertly, in violation of State licensing requirements, and these companies may even be offshore. Do not contract with any company if you cannot verify their physical address and telephone number. Once you give them your money you may not see or hear from them again. Even if you receive a mailer piece from a company that looks to be a legitimate loan modification company, proceed with caution and prudence. If you have been scammed or ripped off by such a company please contact us immediately.

(4) False promises loan modification scam: Did your broker or attorney-backed/attorney-based company promise you something they did not deliver (ex. principal loan reduction, guaranteed loan modification, 100% money-back-guarantee, etc.) and fail to deliver? If so, they may have either ripped you off (fraud, deceit) and/or failed to properly process your loan modification (professional negligence). Many loan modification companies will hold themselves out as "loan modification experts" or "loan modification specialists" even though this business is fairly new and even though the loan modification company may have had no special sill, training or experience in this field.

(5) The loan audit that never happened loan modification: Many brokers and attorney-backed companies are representing that they will get your loan modification processed faster and more efficiently and get you a better loan modification because they will have a "loan audit specialist" or attorney or law firm conduct a forensic loan audit. We have seen many cases where either no loan audit is performed or a lousy one paragraph summary is provided that makes it questionable whether or not the loan audit was ever performed. Especially in regard to Option ARM loans and NEGAM loans we would expect a more thorough loan analysis.

This is just a short list of the types of loan modification scams, frauds, rippoffs and negligence we are investigating on behalf of our homeowner clients. If you feel you have been lied to, cheated, ripped-off, abused or neglected by your loan modification company, please contact us.

When both my husband and I were layed-off from our jobs we began looking for work right away. The “Streamlined Modification Plan,” or SMP, which is an expansion of what many lenders are already doing, will be implemented by December 15, 2008. “This is an important effort by the mortgage industry to help homeowners,” said Faith Schwartz, HOPE NOW’s executive director. “This is a big step forward that will make it easier to modify loans for the most at-risk homeowners so they will be able to avoid foreclosure and stay in their homes.”

Under the new SMP, lenders will use an expedited process to modify, or restructure, a mortgage so that the homeowner can afford the monthly payments. The streamlined process will apply to at-risk borrowers who are 90 days or more late on their existing mortgages and whose loans are owned by Freddie Mac, FNMA or participating balance sheet lenders/servicers.

After compiling the homeowner’s information, lenders will use a simple process that reduces the homeowner’s monthly payment to no more than 38 percent of the borrower’s monthly income. This may include in any combination (1) extending the number of years of the loan, (2) reducing the interest rate, and/or (3) forbearing part of the principal. If these steps are cannot reduce a homeowner’s monthly payment to that affordable level, the borrower will receive an additional loan-by-loan review that will include all other options to prevent foreclosure.

While many lenders have used some combination of these SMP components up to now, the real benefit of the program will be the systematic and uniform approach that lenders will now apply to modifications. This is expected to streamline the process significantly. According to Schwartz, SMP’s consistent guidelines and standards will make it much easier and faster for homeowners to get the assistance they need. “This effort compliments those being made by other institutions and should provide homeowners with real confidence that the mortgage lending industry wants to help them avoid foreclosure,” she said. “SMP will help stabilize the housing market.”

If you really want to work with a reputable company, look them up on the internet. Google the company name and see what comes up.
